
Roger Stone’s attorneys filed a motion on Friday night requesting the federal judge presiding over his bid for a new trial to recuse herself, arguing she could not be impartial because of a statement she made to the jury that convicted him.
The papers filed in a federal court in Washington, DC, highlight the statement by US District Judge Amy Berman Jackson at Stone’s sentencing on Thursday afternoon.
“The jurors who served with integrity under difficult circumstances cared,” Jackson said, according to the motion, after Stone was sentenced to 40 months in federal prison for witness intimidation and lying to congress.
President Trump has raised concerns over the forewoman in Stone’s trail, Tomeka Hart, claiming she should not have been allowed to sit on the jury over social media posts he said displayed a bias.
“It’s my strong opinion that the forewoman of the jury, the woman who was in charge of the jury is totally tainted. When you take a look, how can you have a person like this? She was an anti-Trump activist. Can you imagine this?” he said, referring to Hart.
No jurors, including Hart, were named in Stone’s Friday motion.
Stone, 67, claims in the motion that the judge “blessing the ‘integrity of the jury’ undermines the appearance of impartiality and presents a strong bias for recusal.”
The filing Stone’s bid for a new trial is “related to the integrity of a juror [who] misled the court regarding her ability to be unbiased and fair.”
